Permitted Temporary Depots and Storage Facilities

Under Clause 8(3)(a) of the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011

1. ACTIVITY: Operate a temporary contractors depot/storage yard
LOCATION: 391 Wilsons Road
APPLICANT: Downer NZ Ltd

STANDARDS:
1. The activity must proceed in general accordance with the information submitted to the Council on 9 July 2015.
2. Entry and exit to the site are to be from Lismore Street.
3. The activity must comply with the relevant City Plan noise standards at any nearby occupied residential site at all times.
4. With the exception of the location of the work in proximity to the proposed depot, and the noise limits, the activity must continue to comply with the relevant general Standards for Permitted Temporary Accommodation and Temporary Depots and Storage Facilities under Clause 8(3)(a) of the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011, contained in the public notice issued by the Council on 23 October 2013.
2. ACTIVITY: Temporary Depot and storage facility for adjacent road works
LOCATION: 4 Baladin Street, Avondale
APPLICANT: Fulton Hogan

STANDARDS:
1. The activity must proceed in general accordance with the information submitted to the Council on 26 May 2015.
2. The location of the containers are to be set back at least 1.8m from any boundary between the applicant site and adjoining residential properties.
3. With the exception of the location of the activity, the activity must comply with the relevant general Standards for Permitted Temporary Accommodation and Temporary Depots and Storage Facilities under Clause 7(3)(a) and Clause 8(3)(a) of the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011, contained in the public notice issued by the Council on 23 October 2013 (depots and storage facilities).
4. The activity will cease on or before 31 January 2016.
3. ACTIVITY: Temporary Depot
LOCATION: 29 - 31 Basingstoke Street
APPLICANT: Lambe Construction Limited

STANDARDS:
1. The activity must proceed in general accordance with the information submitted to the Council on 17 July 2015.
2. A notice is to be provided to the residents within the street providing them with a 24 hour free phone number for them to contact should any issues arise.
3. The activity must not create any significant adverse effects (relating, but not limited, to noise, dust, mud, light spill, odour, traffic generation, and visual amenity) that will, in the opinion of a Council Enforcement or Health Officer, cause nuisance for occupiers of surrounding sites. If any significant adverse do arise, then the Council can impose additional requirements or conditions to avoid, remedy or mitigate those adverse effects.
4. The hours of operation on site will be 7.00am to 7.00pm Monday to Saturday. Truck movements will be restricted to between 7.30am to 5.00pm.
5. The activity must cease on or before 31st January 2016.
6. A watering system in the form of sprinklers is to be used to mitigate any potential dust issues from the stock piled materials.
7. Road sweeping of the depot entrance is to be undertaken at regular intervals to ensure materials are not transferred from the site onto the roadway.
8. Upon cessation of the temporary use the site must be grassed and left clean and tidy.

The above activities are permitted in the specified locations until the expiry of the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011. The expiry date is 18 April 2016.
Any temporary activity established under these provisions shall not create or give rise to any existing use right in respect of any land, activity, or structure (refer clause 5(3) of the Canterbury Earthquake (Resource Management Act Permitted Activities) Order 2011).
