Policy reviews

The Christchurch City Council reviewed and adopted several new bylaws in 2008. Under of the requirements of several of these bylaws, an operational policy needs to be formulated, relating to matters regulated by that bylaw.

Such a policy must be adopted by Council resolution, and may include information on application procedures, administrative arrangements, terms and conditions related to the specific application of the bylaw, definition of terms and other guidance information.

The Council has identified several current policies that need to be reviewed in relation to the raft of bylaws adopted in 2008. The review procedure is to ensure the related policy is updated appropriately to give effect to the new bylaw.

With the amalgamation of Banks Peninsula District Council (BPDC) and Christchurch City Council in 2006, some operational policies specific to Banks Peninsula or specific to areas in Christchurch stayed in existence in their respective areas. This has caused some confusion and inconsistency across the communities; the review endeavours to address both the issues of clarity and consistency.

The policies review is also looking at related operational issues/procedures related to a specific bylaw that would benefit from being included in or adopted into its updated operational policy, which may result in some new areas of consideration. 

The Local Government Act 2002 requires the timely review of bylaws in order to ensure that they are still necessary, that they are appropriate and that they meet the purpose they were designed for.

Christchurch City Council Trading and Events in Public Places Policy 2010

The Christchurch City Council has introduced a new Trading and Events in Public Places policy. This new policy incorporated the key components of six previous policies relating to specific trading and activities in public places and related issues, and covers the whole of the Christchurch City Council district, including Banks Peninsula.

The following polices were revoked:

  • Street Trading Policy
  • Stalls in Cathedral Square and City Mall
  • Stall Site Licensing Policy
  • Victoria Square and Victoria Square Amphitheatre (use of)
  • Busking conditions
  • Banks Peninsula District Council Stalls/Market Policy
