Christchurch City Council Alcohol Policy

That the Alcohol Policy as below be adopted by the Council.

1. Special Licences

1.1 General Conditions

In considering any application for a special licence, the District Licensing Agency shall have regard to the following matters:

  • The nature of the particular occasion or event or series of events or occasions;
  • The suitability of the applicant;
  • The days on which, and the hours during which, the applicant proposes to sell liquor, including recognition of any applicable City Plan rule or resource consent condition;
  • The areas of the premises that the applicant proposes should be designated as restricted areas, supervised areas or undesignated areas depending upon the circumstances of the application;
  • The steps proposed to be taken by the applicant to ensure that the requirements of the Sale of Liquor Act 1989 in relation to the sale of liquor to prohibited persons are observed;
  • The applicant′s proposals relating to host responsibility;
  • The operation of the host responsibility programme shall be the responsibility of the licence holder;
  • Each application will be assessed on its merits.

1.2 Specific conditions
The Sale of Liquor Subcommittee (delegated officer) in considering applications for a special licence:

(a) Shall have regard to and apply standards and conditions, applicable and appropriate to the occasion or the event, and in general:

(i) in Living Zones (or in locations adjacent to Living Zones) grant the licensed hours (between the hours of 7am and 1am the following day) on any day of the week; and
(ii) in Business Zones grant licensed hours appropriate to the location, and subject to that on Good Friday, Easter Sunday, Christmas Day, or before 1pm on Anzac Day except for persons living on the premises or a person present for the purposes of dining grant licensed hours in the area bounded by the area defined in the attached map to 3am.

(b) May grant special licences for up to 20 days in any 12 months period at any one venue, unless an increase in number can be justified to the DLA (Council Hearings Panel).
(c) May decline to consider an application where in its opinion there are good reasons to do so and refer the application to the DLA (Council Hearings Panel) for a decision.

1.3 Receipt of special licence applications 20 working days prior to date sought
It is recommended that receipt of any Special Licence application is 20 working days prior to the date sought to allow due process to occur in case of adverse reports being received which could jeopardise the determination prior to the date sought.

2. Premises' operating hours

It is to be a condition of on licences granted for the first time* (and not being renewed) after the date of commencement of this policy that liquor shall not be sold after 3am and not before 7am on the same day other than to:

(a) Any person who is for the time being living on the premises, whether as a lodger or an employee of the holder, or otherwise; or
(b) Any person who is present on the premises for the purpose of dining.

That each application be treated on the merits of the application(s) taking into account the:

  • Nature and location of the proposed activity in terms of its relationship to other activities;
  • Hours of operation of the proposed activity in terms of its relationship to other activities;
  • Suitability of the applicant;
  • Compliance of the premises and activity with all other relevant legislation such as the Building Act 1992 and Resource Management Act 1991, and bylaws;
  • Matters raised in opposition to the application (by the community, The New Zealand Police, Medical Officer of Health or Fire Service);
  • The operation of the host responsibility programme shall be the responsibility of the licence holder;
  • Proposed management plans to deal with on and off-site problems;
  • Persons to whom it is intended that liquor be sold;
  • Any other matters in respect of the application promoting the responsible consumption of liquor.

* first time means premises where “the prospective licensee has never held a liquor licence before operating a premises that has have never been a licensed premises before”.

3. Enforcement

The administration of the alcohol policy and the provisions of the Sale of Liquor Act is the responsibility of the Chief Executive Officer.

4. Use of liquor bans/bylaws

The Subcommittee supports the implementation of liquor ban bylaws.

5. Advertising and sponsorship on Council property

The Subcommittee supports the existing policy.

The Council has a policy titled “Alcohol-Related Harm at Public Events - Policy to Reduce”. It reads as follows:

“This policy is intended to apply to those outdoor events provided by the Christchurch City Council, or on land controlled by the Council, or funded by the Council, where alcohol will be sold or where the time/setting/theme creates the risk of alcohol related harm. Where there is uncertainty about the degree of risk Council staff will consult with Police.

1. At such events provided/funded by the Christchurch City Council, Council staff will facilitate or ensure effective joint planning for the event between key stakeholder groups including but not limited to, Police, District Licensing Agency, security services, health agencies, St John’s, Canterbury Youth Workers Collective, Christchurch Safer Community Council.

2. Where such an event is not provided by the Christchurch City Council, or for events where a degree of risk has been identified, Council will make as a condition of contract or land hireage, that effective joint planning happens between event organisers/promoters and key stakeholder groups including but not limited to, Police, District Licensing Agency, security services, health agencies, St John’s, Canterbury Youth Workers Collective, Christchurch Safer Community Council.

3. Planning for the event will include strategies:

  • To reduce alcohol-related harm.
  • To care for any people affected by alcohol

4. Pourage rights will be provided without sponsorship rights wherever possible.

5. The Christchurch City Council will extensively explore other avenues before accepting alcohol sponsorship at public events."

6. Other matters

(a) Off Licence Premises

That "stand-alone bottle stores" ** trading hours be limited to between 7am and 11pm, and that a supervised area designation be placed on such stores/premises.

** "stand-alone bottle stores" means premises where the main and principal business is the sale and supply of liquor (and does not include a supermarket).
