Council moves on Taylors Mistake baches

23 July 2010

The Council today decided to put into effect the Environment Court 2003 decision on the baches at Taylors Mistake and Boulder Bay.

The decision has already been incorporated into the City Plan.

The decision requires the Taylors Mistake Association to take immediate steps to:

(i) Prepare a planting concept plan for the Taylors Mistake Bay zone which satisfies the Council.

(ii) Issue leasehold titles in the TMB zone which fall within the provisions in the City Plan.

(iii) Transfer to the Council the land to the east and south of the TMB zone so it can be vested as recreation reserve under the Reserves Act 1977.

(iv) Confirm the Association’s undertaking on behalf of affected bach owners that once these conditions have been fulfilled, all unscheduled baches will be removed.

The Council also resolved to authorise the Chief Executive to negotiate licences with the owners of baches which are scheduled to remain at Taylors Mistake and Boulder Bay and which are situated on land vested in the Council as legal road.

However, the Council’s decision to negotiate licences for the baches does not mean that licences will automatically be granted in other situations where unauthorised structures have been built on Council-owned land
