What is a Building Line Restriction?

Some properties will have building line restrictions recorded on the Certificate of Title, stating “subject to building line restriction” (or BLR) plus the document number.” Historically BLR’s were placed on the title at the time of subdivision where the road was less than 20 metres wide. The titles would specify that buildings were not allowed to be sited within a certain distance from the centre line of the road or within a certain distance from the road boundary, to allow for future road widening.

Building Line Restrictions are superceded by the City Plan setbacks. The Building Line Restriction may remain on the title without effect, or if the applicant wishes can be cancelled, subject to the payment of a fee and the supply of the Building Restriction Line document and title.

If you wish to have the BLR removed from your title, provide the following:

1.a) a written request that Council prepares and executes a cancellation of the building line restriction

b) a copy of the Certificate of Title

Payment of a fee is required. Check the current fee with Council.

2) Once prepared and executed the cancellation document will be returned to the applicant. (The approximate processing time is 10 working days.)

3) The applicant or their solicitor then registers the document with the Land Information NZ.
