Can I build a small accessory building (eg shed, pergola, gazebo, glasshouse, sleepout) without a building consent?

Yes, if the building:
- is under 10 square metres in area
- contains no sanitary facilities
- is single storied
- Is at least its own height away from the property boundary and from any residential building on the property or any neighbouring property
- is not a spa or swimming pool enclosure/fence.

Even if a building consent is not required, the construction still needs to comply with the NZ Building Code. This includes spouting/stormwater control.

You will need a building consent if it does not meet these requirements.

Note:
The definition of a building within the City Plan is different from the Building Act and different setback requirements are specified in the City Plan for any structure greater than 6m2 in area or 1.8m in height. These requirements include:

  • For accessory buildings closer than 1.8m to the boundary there is a maximum length of the buildings within this distance. This maximum length is 9.0m for most residential zones, or 10.1m for inner city residential zones, however, this includes any other accessory buildings (e.g., garages) within 1.8m of the boundary along that boundary line.


  • Accessory buildings are required to be within recession planes (these start at 2.3m above existing ground level at the boundary and vary depending on each boundary orientation).


  • Most residential areas require a minimum setback of 4.5m from the front property boundary.

  • There are also restrictions on the percentage of the site that can be covered by buildings. This is usually 35% or 40% for most residential zones, but should be confirmed with a planner.

    All building work must comply with the Health Act 1956 and the Resource Management Act 1991. These acts relate to nuisance and noise from building works amongst other requirements.
