Status of Proposed Banks Peninsula District Plan
The Banks Peninsula Proposed District Plan is a formal legal document prepared in accordance with the Resource Management Act 1991.
The purpose of the Banks Peninsula District Plan is to provide a framework for the management of land use and subdivision within the Peninsula with the overall intention of achieving the purpose of the Act which is set out Section 5 of the Act. It is:
"...to promote the sustainable management of natural and physical resources"
The Plan is still proposed and not yet operative.
The Banks Peninsula District Plan was publicly notified in 1997 for submissions. Since then most of the urban and rural provisions in the Plan have been resolved. i.e. they have been the subject of submissions, further submissions, hearings, decisions and appeals. The only parts of the Plan yet to be resolved are those sections relating to financial contributions, monitoring, and designations. Once all of the provisions in the District Plan are beyond the point where they are subject to any variations/ submissions/ appeals, the plan can be prepared to be made operative.
The Plan has been the subject of a number of appeals with the Environment Court. The status of these appeals are summarised here.
The abolition of the Banks Peninsula District Council has no effect on the status of the Banks Peninsula Proposed District Plan. It remains in effect for the same area until the Plans (Banks Peninsula District Plan and Christchurch City Plan) are merged at some date in the future.

The latest version of the Plan was printed in March 2006. Since then there have been some amendments as a result of Environment Court decisions. These updates are listed below. Note -the online version of the March 2006 Plan is regularly updated to include the latest amendments.
