Traffic and Parking Bylaw 2008
The Bylaw was adopted by Council on 19 June 2008. This Bylaw comes into force on 1 July 2008.
The Christchurch City Council Traffic and Parking Bylaw 2008 will regulate and control traffic, parking and the movement of stock in such a way as to balance the competing demands on the road space while maintaining a safe and efficient infrastructure. The Bylaw sets out various rules relating to these matters. It also provides the Council with a means to address the various parking concerns of local communities and also as to use of a particular road as those issues arise in each community.
The new Bylaw covers:
- the regulation and control of traffic and parking
- the regulation and control of traffic movement restrictions
- the management of traffic and parking during events
- the regulation of vehicle crossings
- the regulation of machinery or equipment on roads
The main changes to the Traffic and Parking Bylaw are:
- amalgamating both the ‘vehicles on grass berms’ and ‘vehicles on grass verges’ clauses into a single new clause restricting parking on grass verges and berms
- the ‘heavy vehicle parking on residential streets’ clause has been amended by removing the times, therefore allowing the times to be set as the context requires (a recommendation has also been made to develop a policy on the process for making decisions on where any restrictions are imposed)
- removing the ‘heavy vehicles using residential streets’ clause, as section 70AA of the Transport Act 1962 already empowers the Council to restrict heavy vehicles from using streets (this does not need to be duplicated in the Bylaw)
- the ‘caravans’ and ‘immobilised vehicles’ clauses have been amalgamated and altered – the clause now covers motorhomes and immobilised vehicles
- the ‘displaying vehicles on streets’ clause has been altered by removing those parts of the clause that related to sale or exhibition, and it now focuses on restricting the use of the road for storage of vehicles in connection with a trade or business.
Submissions on the proposed Bylaw were open from 29 March to 1 May 2008. The hearings were held on 19 and 20 May and the panel deliberated from 20 May to 11 June. The report of the Hearings Panel is available on the Council Website.
The new Bylaw revokes and replaces the following:
- Christchurch City Traffic And Parking Bylaw 1991
- Banks Peninsula District Council Licences for Vehicle Stands on Streets Bylaw 1972
- Banks Peninsula District Council Traffic and Parking Bylaw
- Banks Peninsula District Council Stock Control Bylaw 1994
- Banks Peninsula Mobile or Travelling Shops and Hawkers and Itinerant Traders Bylaw 1996 (in part)
