Banks Peninsula District Council Nuisances Bylaw 1996 review
This is a proposal by the Christchurch City Council to revoke the Banks Peninsula District Council Nuisances Bylaw 1996.
Submissions
Submissions on this proposal may be made to the Council between 15 March and 16 April 2008.
Hearings will be held from 28 April to 2 May 2008.
Any person who makes a submission will have the opportunity to be heard by the Council, but must make that request. The submitter's name, address and contact telephone number must be included on the first page. No anonymous submissions will be accepted. The Local Government Act 2002 requires the Council to make all written submissions made on a special consultative procedure available to the public. This requirement is subject to the provisions of the Local Government Official Information and Meetings Act 1987. Background
The purpose of the Bylaw was to control various nuisances in the Banks Peninsula District. Prior to the Banks Peninsula District joining the Christchurch City Council the Council did not have a bylaw covering these nuisances.
A review of the Bylaw has been undertaken to ascertain whether the provisions of the Bylaw are still required. There appears to be no need to continue or replace the Bylaw because the problem addressed in the Bylaw can be dealt with by the Council under the enforcement powers of the Health Act 1956, the Resource Management Act 1991, or the Building Act 2004.
