Banks Peninsula Building Consent
A Building Consent is a consent to begin building work, in accordance with the approved plan specifications. All Building Consents must comply with the requirements of the New Zealand Building Code.
You need a Building Consent for nearly all building work or excavation work you are going to carry out. You will need to refer to Schedule 1 of the Building Act 2004; or if you are unsure please discuss your proposal with a Council Building Official.
You may also need a Resource Consent before you can begin work as detailed on your Building Consent.
The types of activities that could require a building consent are
- New houses
- Extensions to houses
- Relocating a house to another section
- Pools
- Decks
Application
You will need to obtain an application form from the Council or click on the PDF file below. You will need to ensure that you have provided all information requested. Depending on the complexity of your project you may need to get advice from a specialist e.g.registered engineer (structural, geotechnical); architect; draughtsperson; surveyor; etc.

Note: If the building or alteration is within the Lyttelton Harbour Basin or Port Levy area the completed application form, plans and fees should be sent to the Lyttelton Service Centre for processing.
If the building or alteration is within the Akaroa Harbour Basin, Wairewa or Outer Peninsula Bays the completed application form, plans and fees should be sent to the Akaroa Service Centre.

Process - A Building Consent is required to be processed within 20 working days.
Note: The prescribed period for issue for the consent will be suspended if further information is required.
The work authorised by a Building Consent must start within 12 months after the date of issue of the consent otherwise the Consent will be deemed to have lapsed. You may apply for an extension of this time prior to the expiry of this 12 month period.
Code Compliance Certificates to be issued within 2 years from the date the consent was issued.
Building Inspections
Council Officials will inspect your building activities to ensure they comply with the approved plans. Several different inspections will be required depending on the building.
The Building Act requires the owner or person carrying out building work under a Building Consent to give the Council 2 working days notice of their intention to commence work.
Compliance Schedules and Building Warrants of Fitness
Compliance schedules are provided by the Building Act 2004 to ensure that building owners take responsibility for ensuring the safety of building occupants and buildings.
Buildings containing certain safety features and essential systems, such as fire alarms and lifts, require a compliance schedule.This is especially so for owners of communal, commercial and industrial buildings.
It means that the building owner must keep safety features and essential systems in good working order (e.g. lifts, escalators, automatic sprinklers etc.).
A Compliance schedule lists the building's safety features and essential systems and the inspection, maintenance and reporting procedures needed to keep them in good working order.
A copy of the Building Warrant of Fitness must be provided annually to the Council and publicly displayed at the building it pertains to.
Compliance schedule information must be presented as part of the Building Consent application where Specified Systems are relevant to the building / alteration.
